Terms of Service

By accessing or using 4sight ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

4sight is a wellness intelligence platform that helps users track and analyze health data across four pillars: Move (activity), Fuel (nutrition), Rest (sleep), and Rise (mental wellness).

The Service includes:

• Mobile applications for iOS and Android
• Web dashboard for viewing health data and managing your account
• Integration with health platforms including Apple HealthKit, Google Health Connect, and Fitbit
• Data import from compatible devices and services (RingConn, Lose It!, smart scales)
• AI-powered wellness insights, pattern analysis, and personalized recommendations (Premium feature)
• Data export in multiple formats (PDF, CSV, JSON)

To use 4sight, you must create an account using email/password, Google Sign-In, or Apple Sign-In. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activity under your account

You must be at least 13 years old to use 4sight. Users between 13 and 18 require parental consent.

Free Tier: Basic health tracking, Health Connect sync (Android), HealthKit sync (iOS), daily reminders, manual logging, and a basic dashboard are available at no cost.

Premium Subscription: Premium features are available at our inaugural launch price of $7.99/mo or $79.99/yr. Regular pricing is $9.99/mo or $99.99/yr. Launch pricing is available for a limited time for early subscribers and will be honored for the duration of an active subscription. Premium includes a 14-day free trial for annual plans and a 7-day free trial for monthly plans. Premium includes:

• AI-powered wellness insights and pattern analysis
• Advanced analytics and trend reports
• Data export (PDF, CSV, JSON)
• Fitbit integration
• Data import (RingConn, Lose It!, smart scales)
• Food search database
• Goal recommendations
• Priority support
• Family sharing (up to 5 members)
• Custom themes

Billing: Subscriptions are billed through the Apple App Store (iOS), Google Play (Android), or Stripe (web). Payment terms are subject to the respective platform's billing policies.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the period expires. To cancel:

• iOS: Settings > Apple ID > Subscriptions > 4sight
• Android: Google Play > Subscriptions > 4sight
• Web: Settings > Subscription within the 4sight dashboard

Refunds: Refund requests within 30 days of initial purchase will be honored. For App Store or Google Play purchases, refunds are subject to the respective platform's refund policy. Contact [email protected] for assistance.

Price Changes: We may change subscription pricing with at least 30 days' notice. Price changes will not affect your current billing period.

You retain ownership of all health data and content you provide to 4sight. By using the Service, you grant us a limited, non-exclusive license to:

• Store and process your data to provide the Service
• Generate insights and analytics from your data, including through AI/LLM processing
• Create anonymized, aggregated data for service improvement (never personally identifiable)

You may export your data at any time in PDF, CSV, or JSON format. You may also request permanent deletion of all your health data through Settings > Privacy.

You are responsible for ensuring you have the right to share any data you provide.

4sight uses artificial intelligence to provide wellness insights, pattern correlations, and personalized recommendations. By using AI features, you acknowledge that:

• AI-generated insights are informational only and do not constitute medical, health, or fitness advice
• Your health data may be processed by third-party AI service providers to generate insights
• AI providers are contractually bound not to retain or use your data for their own purposes
• AI outputs may contain inaccuracies and should be verified against your own judgment and professional advice
• AI features are available only to Premium subscribers

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems or other users' data
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or disassemble the application
• Share your account credentials with others
• Use automated systems, bots, or scrapers to access the Service without permission
• Misrepresent your identity or affiliation
• Circumvent subscription restrictions or access premium features without a valid subscription

4sight is not a medical device and does not provide medical advice.

The Service, including AI-generated insights, is intended for informational and wellness tracking purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or health condition.

Always consult with a qualified healthcare provider before making decisions about your health. Never disregard professional medical advice or delay seeking it because of information provided by 4sight.

AI-generated wellness insights, scores, and recommendations are based on pattern analysis of your personal data and are not a substitute for professional medical evaluation.

If you have a medical emergency, call your local emergency services immediately.

4sight integrates with the following third-party services. Your use of these integrations is subject to those services' respective terms and privacy policies:

• Apple HealthKit - Health data sync on iOS devices
• Google Health Connect - Health data sync on Android devices
• Fitbit - Activity, sleep, and health data sync (Premium feature)
• Firebase (Google) - Authentication and app analytics
• Stripe - Payment processing for web subscriptions
• Apple App Store / Google Play - In-app purchase processing
• AI Service Providers - Wellness insight generation (Premium feature)

We are not responsible for the availability, accuracy, or content of third-party services. Integration availability may vary by platform and subscription tier.

4sight and its original content, features, and functionality are owned by 4sight and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission. AI-generated insights are provided for your personal use only and may not be commercially redistributed.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 4SIGHT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, or goodwill
• Any damages resulting from your use or inability to use the Service
• Any health decisions made based on information or AI-generated insights from the Service
• Any inaccuracies in AI-generated wellness insights or recommendations
• Any interruption, loss, or corruption of data during sync with third-party health platforms

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

You agree to indemnify and hold harmless 4sight and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion.

You may terminate your account at any time by using the account deletion feature in the app or web dashboard, or by contacting [email protected].

Upon termination:

• Your right to use the Service ceases immediately
• Active subscriptions will not be refunded for the remaining billing period
• Your data will be deleted in accordance with our Privacy Policy
• You may export your data before account deletion

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration against 4sight.
